Below you will find information about what personal data is collected, how it is processed, and your rights related to the processing.

Processing of Personal Data

We collect and use personal data for different purposes depending on who you are and how we interact with you. Personal data means any information that can be linked to an individual (“data subject”). Processing means any operation performed on personal data, such as collection, registration, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure, dissemination, restriction, erasure, or destruction.

Mobile Terms of Service

The Berserker AS mobile message service (the "Service") is operated by Berserker AS (“Berserker AS”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Berserker AS’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Berserker AS through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Berserker AS. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Ansur or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Berserker AS mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Services – Online Store

We collect and process personal data when you use our services, for example, when you purchase items through our online store.
The purpose and legal basis for processing your personal data are:

• To fulfill our agreement with you if you order and purchase goods from our website (GDPR Art. 6 (1)(b)).

• To manage our customer relationships, ensure and improve our services, and protect our legal rights (based on our legitimate interests, GDPR Art. 6 (1)(f)).

• To comply with statutory obligations related to accounting, tax handling, warranty, and returns (GDPR Art. 6 (1)(c)).

• Where applicable, we also process data based on your consent (GDPR Art. 6 (1)(a)).

Categories of Data We Collect

1. Information you provide us with
   When making a purchase or creating an account, we collect:

   • Name

   • Email address (used for communication regarding your order and customer relationship)

   • Phone number (used for communication regarding your order and customer relationship)

   • Address (for delivery of goods)

   • Bank account number (if you register this for refunds)

   • Date of birth (optional)

   We also store your IP address for security purposes when an order is placed.

   Date of birth, if provided, may be used to send birthday greetings or for age-segmented analytics.

   Account information is stored as long as your account is active or until you delete it. Accounts with no purchases will be deleted after 12 months of inactivity. Accounts with orders will be deleted 5 years after the last activity. You will be notified by email before deletion.

   We may also process data related to complaints, claims, or other matters tied to our services.

2. Information we receive when you use our services
   We collect log data related to changes in your customer profile (e.g., address or phone number updates), as well as information on categories and products you search for or click on. This is used to improve our services, show you relevant products, and generate traffic statistics.

   We also use cookies and similar technologies to collect information about your activity, browser, and device.

Payment Processing

We use Dintero Checkout. When you proceed to checkout, personal data (e.g., card number, contact details, and order details) is transferred to Klarna to manage your payment. Klarna acts as an independent data controller and processes personal data in accordance with its own privacy policy. For security reasons, any registered bank account numbers are deleted 3 months after their purpose has been fulfilled.

Customer Support

If you contact us via customer service or otherwise communicate with us, we may process:

• Name

• Email address

• Phone number

• Order number

• Information you choose to provide

This information may also be used internally to test and improve our IT systems.

Newsletters

We send newsletters to subscribers who have actively opted in. To do this, we process your email address for the purpose of distribution. You may withdraw your consent at any time by using the unsubscribe link in the newsletter or contacting us directly.

SMS Services

If you sign up for SMS notifications, you consent to receiving promotional offers, campaigns, and reminders to your phone number. You can unsubscribe at any time by replying STOP or clicking the opt-out link in the message.

Cookies and Website Use

We use cookies to improve your experience, provide functionality, analyze traffic, and personalize content and ads. Information may be shared with our partners for social media, advertising, and analytics.

Most browsers automatically accept cookies, but you can adjust settings to decline them. Note that some site functionality may not work properly without cookies.

Storage and Deletion of Personal Data

Personal data is stored as long as necessary for the purposes collected and is deleted in line with regulatory requirements. Data may also be anonymized instead of deleted.

• Data based on consent is deleted if consent is withdrawn.

• Data processed under a contract is deleted when the agreement is fulfilled and statutory obligations are met.

• Data processed under legal obligations is deleted once those obligations end.

Sharing and Transfer of Data

We do not sell or trade personal data. Data may be shared with third parties only when:

• Necessary to fulfill an order (e.g., payment partners, shipping providers).

• Required by law (e.g., tax authorities, auditors, law enforcement).

• In connection with mergers, reorganizations, or acquisitions, subject to contractual guarantees.

We may use processors (service providers) for tasks such as storage, IT, or logistics. In such cases, strict data processing agreements are in place.

Transfers outside the EEA are only conducted if in compliance with GDPR Chapter V, either to EU-approved countries or with proper safeguards (Art. 46(2)).

You may delete your account at any time by logging into “My Account” or contacting customer support.

We may update this privacy policy from time to time due to changes in services, websites, or applicable regulations. Updated information will always be available on our website. If significant changes occur and we have your contact information, we will notify you directly.
